Sia’s estranged husband, Dan Bernad, has been denied his request for sole custody of their one-year-old son following a heated court battle.
A judge in Los Angeles County dismissed Bernad’s motion and ruled that the couple must continue following their existing custody agreement, citing a lack of sufficient evidence to support his claims.
“The court finds that sufficient exigency for the requested emergency relief has not been shown at this time,” stated the court documents obtained by Page Six.
“The parties entered into a stipulated legal custody and interim physical custody arrangement on August 1, 2025. Most of the facts asserted in Respondent’s RFO were known at that time.”
In his filing, Bernad argued that he should have full custody, describing himself as the “only safe and reliable parent” for their son and accusing the Chandelier singer of posing a “serious and immediate danger” to the child.
“Sia is an unfit and unreliable parent struggling with substance abuse and addiction, rendering her incapable of providing safe or stable care,” the oncologist claimed.
“I am a doctor, young, healthy and have no criminal history or drug or alcohol addiction issues.”
The pair married in December 2022 and welcomed their son in March 2024. Sia filed for divorce a year later, in March 2025.
